thosematerialswhichmust be reviewed
or updatedperiodically. After three years
from thedate of execution the; annual
MVR, annual reviewof driving record,
annual list of violations, themedical
examiner’s certificate, anymedical
variance issuedby theFMCSA, and the
note relating to verificationofmedical
examiner listingon theNational Registry
ofCertifiedMedical Examiners canbe
discarded.
While theFMCSAhasmade the
following exceptions to theDQ
file requirements;NBIS strongly
recommendsmaintaining a complete
DQ file (as defined in§391.51) for
ANYdriver operating aCMV for your
company.
Multiple-employer driver
Amultiple employer driver is defined in
§390.5 as adriver, who in anyperiodof
seven consecutivedays, is employedor
used as adriver bymore thanonemotor
carrier. Themotor carriermust have
on file thedriver’s name, social security
number, identificationnumber, type,
issuing state of his/hermotor vehicle
operator’s license,medical certificate,
road test and certificate, and controlled
substance test results, even if that driver’s
primary employment iswith another
carrier.
It is essential themotor carrier comply
with all the requirements of Part 391,
except the carrier needNOT–

Require the person to furnish an
application (§391.21);

Make an inquiry into the person’s
driving record during the preceding
three years to the appropriate State
agency(s) and an investigation of the
person’s employment record during the
preceding three years (§391.23);
3
Perform annual review of the person’s
driving record (§391.25); or
4
Require the person to furnish a record
of violations or a certificate (§391.27)
In conclusion, determiningwhether
or not aDQ file is required; andwhat
is necessary tobemaintainedwithin
that file canbe very intimidating and
having an insurancepartner that has the
